Broward County resident sues loan servicing firm

Mortgage

MIAMI — A Broward County resident is suing a loan servicing firm, saying its alleged failure to follow the law caused the plaintiff to suffer emotional distress, anxiety and shock.

Eliana Nordelus is suing Nationstar Mortgage LLC, citing alleged violation of the Real Estate Settlement Procedures Act. Nordelus filed a lawsuit on Feb. 5, 2016, in U.S. District Court for the Southern District of Florida.

According to the complaint, the plaintiff claims to have suffered emotional distress, anxiety and shock, and holds Nationstar Mortgage LLC responsible because the defendant allegedly failed to acknowledge receipt of a loss mitigation package submitted by the plaintiff's legal representation, Loan Lawyers.

The plaintiff seeks the following: compensation for actual and statutory damages, reasonable attorney's fees, costs and expenses and any other relief that the court may deem just and proper. The plaintiff is represented by Aaron Silvers and Yechezkel Rodal of Loan Lawyers LLC in Fort Lauderdale, Florida.
