MIAMI – An Oklahoma insurance company is suing a Florida man and two businesses in the state over a dispute surrounding an insurance policy.

Landmark American Insurance Co. filed a lawsuit on Feb. 4  in U.S. District Court for the Southern District of Florida Miami Division against La Rosa Logistics Inc., The E.T. Family Partnership and Carlos E. Busto.

According to the complaint, Busto sued The E.T. Family Partnership on Feb. 26, 2014 for injuries he allegedly suffered while exiting his place of employment, La Rosa Logistics, in 2012. La Rosa was subleasing the property from Associated Grocers Inc., which held the original lease with the E.T. Family Partnership.  Subsequently, The E.T. Family Partnership sued La Rosa on May 26, 2015, alleging it is indemnified from paying any damages owed to Busto.

Landmark, which had issued an insurance policy to La Rosa, seeks a declaratory judgment indemnifying it from liability in Busto’s suit. It is represented by attorneys Benjamin L. Bedard and Laura E. Bedard of Roberts, Reynolds, Bedard & Tuzzio PLLC in West Palm Beach.
