Tech company accuses Biz To Biz Direct Inc. of copyright infringement

WEST PALM BEACH – Illinois-based technology company Voltstar Technologies is suing Biz To Biz Direct Inc. over allegations of patent infringement.

Voltstar Technologies Inc. filed suit on Jan. 4 in the U.S. District Court for the West Palm Beach Division of the Southern District of Florida against Biz To Biz Direct Inc., doing business as BBD Mobile Accessories, citing patent infringement under U.S. patent laws.

The plaintiff is an Illinois corporation with an office in Palm Beach County, the suit states. According to the complaint, James W. McGinley, Donald Rimdzius and David P. Marcusen invented a charger plug with improved package on May, 21, 2008, for which they applied for and legally obtained a U.S. Patent on May 5. They purportedly assigned all rights to Horizon Technologies, which was renamed Voltstar Technologies Inc. in 2010.

According to the complaint, the patented product in question is a connector between a source of AC power and a device such as a mobile phone with a battery able to be recharged through the use of DC power. The plaintiff alleges that the defendant used the patented designs of the power adapter in a way that constitutes literal infringement of U.S. patent laws to sell its design. It also alleges that the defendants’ description of its power adapter constitutes contributory infringement of its patent.

Voltstar Technologies seeks damages sufficient to compensate for infringement, no less than a reasonable royalty, and costs to be determined by a trial by jury. It is represented by Jerold I.
