Carnival Miracle passenger blames ship's owner for fall

MIAMI—A Colorado woman is seeking damages for injuries she claims to have sustained aboard the Carnival Miracle.

Lorraine Atencio filed a federal claim on Jan. 15 in the Miami Division of the Southern District of Florida against Carnival Corporation, citing negligence.

According to the claim, Atencio was a paying passenger aboard the Carnival Miracle on April 12, 2015, when she allegedly slipped and fell on the Lido Deck. The plaintiff alleges that the flooring surface was wet, slippery, and/or hazardous, which she states is a direct result of the defendant’s negligence. Atencio claims that the defendant failed to monitor the area or warn the passengers of the dangerous flooring, and failed to utilize generally safe practices. She avers that she suffered physical pain, injuries to her body and extremities, lost wages, and future impairments.

Atencio seeks judgment and all damages recoverable by law. She is represented by Jason R. Marguiles and Jacqueline Garcell of Lipcon, Margulies, Alsina & Winkleman, P.A.
